succEZion is operated by Direct Tech Pty Ltd (“Direct Tech”, “succEZion”, “we”, “us” or “our”).

We respect your privacy and are committed to handling personal information responsibly.

This Privacy Policy explains how we collect, use, store and disclose personal information in connection with the succEZion website, Business Transferability Assessment and Business Transferability System.

Where the Privacy Act 1988 (Cth) and the Australian Privacy Principles apply to us, we will handle personal information in accordance with those requirements.

Depending on how you interact with succEZion, we may collect information such as:

• your name and email address;
• business name and business contact details;
• information you provide when completing the succEZion Business Transferability Assessment;
• information provided when contacting us or corresponding with us;
• information relating to purchases and transactions;
• technical information such as IP address, browser, device and website usage information; and
• other information you choose to provide to us.

Some assessment responses relate primarily to your business rather than you personally. However, information may constitute personal information where it identifies, or could reasonably identify, an individual.

Please do not provide sensitive personal information unless it is genuinely necessary.

We may collect personal information when you:

• visit the succEZion website;
• complete the Business Transferability Assessment;
• request or receive your assessment results or report;
• purchase the succEZion Business Transferability System;
• subscribe to communications;
• contact us; or
• otherwise interact with succEZion.

Information may also be collected or processed through service providers we use to operate the website, assessment, payment, email and communications functions.

We may use personal information to:

• provide and administer the Business Transferability Assessment;
• generate and deliver assessment results and reports;
• process purchases and provide purchased products;
• communicate with you about succEZion;
• respond to enquiries and provide support;
• maintain and improve our website, assessment and products;
• understand how our website and services are being used;
• maintain security and help prevent fraud or misuse;
• keep appropriate business, accounting and transaction records;
• comply with legal obligations; and
• send marketing or informational communications where you have consented or where otherwise permitted by law.

You may unsubscribe from marketing emails at any time using the unsubscribe facility provided in those communications.

The succEZion Business Transferability Assessment uses information you provide to generate assessment scores, observations, priorities and related content.

Assessment results are intended as a general business diagnostic.

They are not a determination of business value, saleability or transaction readiness and do not constitute legal, tax, accounting, financial or other professional advice.

We may retain assessment information so that we can:

• provide your results and report;
• maintain appropriate business records;
• support the operation of the assessment;
• respond to enquiries; and
• maintain and improve succEZion.

Payments for succEZion products may be processed using Stripe or another disclosed payment provider.

Payment providers may collect information required to process a transaction, such as your name, email address, billing information and payment information.

Where Stripe processes a payment, payment information is handled through Stripe’s systems.

We do not intend to collect or store your complete payment card details ourselves.

Payment providers may process personal information in Australia and overseas in accordance with their own privacy practices.

We use third-party service providers to operate parts of succEZion.

These currently include:

• GoDaddy — website hosting, website operation and associated functionality;
• ScoreApp — operation of the succEZion Business Transferability Assessment, collection of assessment responses and delivery of assessment results; and
• Stripe — payment processing.

We may also use providers for:

• email and communications;
• data storage;
• security;
• analytics;
• administration; and
• related business functions.

These providers may process personal information on our behalf or in connection with the services they provide.

Some of these providers operate internationally. Accordingly, personal information associated with succEZion may be processed, stored or disclosed outside Australia.

Likely overseas locations include the United Kingdom and United States, and information may also be processed in other jurisdictions used by relevant service providers.

Where Australian privacy law applies to an overseas disclosure, we will take reasonable steps required by applicable law in relation to that disclosure.

We do not sell personal information.

We may disclose personal information:

• to service providers assisting us to operate succEZion;
• where necessary to process a purchase or provide a requested service;
• to professional advisers where reasonably necessary;
• where required or authorised by law;
• where reasonably necessary to protect our legal rights, users or systems; or
• in connection with a sale, restructuring or transfer of all or part of the succEZion business, subject to applicable confidentiality and legal requirements.

We do not disclose personal information to third parties for their own unrelated marketing purposes without appropriate permission.

The succEZion website and third-party services used with it may use cookies or similar technologies.

These may be used to:

• operate website functionality;
• remember user preferences;
• understand website traffic and usage;
• improve website performance;
• maintain security; and
• support assessment or payment functionality.

Your browser may allow you to restrict or delete cookies.

Some website functions may not work correctly if certain cookies are disabled.

Purchasers of the succEZion Business Transferability System may choose to use the System with a suitable third-party AI service.

succEZion does not itself provide the AI service.

The purchaser is responsible for:

• selecting an AI provider appropriate to its circumstances;
• reviewing that provider’s privacy, security, retention and data-use settings;
• determining what information is appropriate to provide to that service; and
• complying with any contractual, confidentiality, privacy, regulatory or professional obligations affecting that information.

Users should not place passwords, PINs, multi-factor authentication codes, recovery keys, private encryption keys, API secrets or similar credentials into ordinary succEZion records or AI conversations.

Where sensitive, confidential or third-party information is involved, users should consider whether that information needs to be provided and whether it should first be removed, anonymised, minimised or redacted.

Information that a purchaser independently provides to a third-party AI service will also be handled under that provider’s own terms, privacy policy and service settings.

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

We also use established third-party providers for important functions such as hosting, assessment delivery and payment processing.

No internet-based system can be guaranteed to be completely secure, and users should take appropriate care when providing information online.

We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including:

• providing products and services;
• maintaining business and transaction records;
• responding to enquiries;
• resolving disputes; and
• complying with legal obligations.

When information is no longer reasonably required, we may delete it, de-identify it or otherwise dispose of it appropriately.

You may contact us if you wish to:

• request access to personal information we hold about you;
• ask us to correct inaccurate or incomplete personal information; or
• raise a question about how your personal information has been handled.

We may need to verify your identity before responding to a request.

Where applicable law gives you a right of access or correction, we will deal with the request in accordance with that law.

We will consider your complaint and respond within a reasonable period.

Where the Privacy Act applies and you are not satisfied with our response, you may also have the right to make a complaint to the Office of the Australian Information Commissioner (OAIC). 

The succEZion website may contain links to third-party websites or services.

Those third parties operate under their own privacy policies and practices.

We encourage you to review the relevant privacy policy before providing personal information to another organisation.

We may update this Privacy Policy as succEZion, our technology, service providers or applicable requirements change.

The current version will be published on the succEZion website with its effective date.
